How much does civil liability insurance for enterprises - sources of increased danger cost?
The amount of the insurance premium is determined according to the tariff plan established by the Insurer, taking into account:
- the type of industrial facility/technical installation with potential danger;
- the level of danger of the industrial facility/technical installation, according to the legislation;
- its operating factors, reception, use, processing, and storage of hazardous substances at the site in specific volumes;
- the territory and location of the facilities.
What documents are required for concluding a civil liability insurance contract for enterprises with increased danger?
The contract is concluded based on a Questionnaire-Application, to which the following must be attached:
- A list of hazardous industrial objects for which insurance is requested;
- Documents characterizing hazardous industrial objects (depending on the type of insured object): technical (operational) manuals; control report or inspection report/conclusion of an accredited and registered inspection body confirming that the technical installation/technological system is safe to operate;
- A copy of the Insured's registration certificate;
- A copy of the extract from the State Register of legal entities of the Insured.
What does an insured event mean, and what measures should the insured take when it occurs?
An insured event refers to the occurrence of an insured risk – a future, possible, but uncertain phenomenon specified in the insurance contract. When it occurs, the Insurer is obligated to provide compensation within the liability limits stated in the Insurance Contract, provided that:
Upon the occurrence of the insured event, the Insured is obliged to:- Notify the Insurer in writing immediately, but no later than 48 hours from the moment of the alleged insured risk. The notification must be submitted to the central office of "MOLDASIG" S.A. or sent to the company's email address: [email protected];
- Immediately inform the competent authorities responsible for investigating the circumstances and determining the causes of the insured event;
- Request a document from the competent authorities confirming the occurrence of the insured event;
- Draft a notification regarding the insured event, signing and dating it. In case of dispute, the Insured must provide proof of notification. The notification should include: the insurance contract details, the insured object, the cause of the risk, and an estimated evaluation of the damages, along with the date and time of registration. Additionally, it should mention cases of negative influence (e.g., non-insured risks, if applicable) on the insured objects;
- Preserve the damaged goods in the state they are in after the event to allow the Insurer to determine its causes and assess the damage. Examination of the insured objects to determine the cause of the insured risk and assess the damage is conducted only with the participation of the Insurer's representative.
