Mandatory liability insurance for carriers towards passengers

According to the law, carriers are required to enter into annual contracts for mandatory carrier liability insurance for passengers with an insurance company. The insurance contract must be concluded before obtaining a license to carry out passenger transportation, and the carrier is obligated to renew this contract for a new term.

Mandatory carrier liability insurance for passengers does not apply to carriers transporting passengers:

• by urban road transport, including taxis and electric transport;
• by suburban road transport, ferries, and river transport on sightseeing and excursion routes.

What constitutes an insured event, and what measures should be taken upon its occurrence:

An insured event refers to the occurrence of an insured risk (a possible but uncertain event) as stipulated in the insurance contract, upon which the Insurer becomes obligated to pay insurance compensation.
In the event of an insured case, the Insured is obligated to:

• take measures within their control to reduce the occurrence of the insured event or limit its consequences;
• immediately report the incident to the authorities and request an official report on the causes and circumstances of the incident, as well as the damages incurred;
• notify the Insurer in writing within 3 days of the road accident, even if the injured passengers have not made any claims.

The Insured must provide the Insurer with the following documents related to the road accident:

• the travel ticket of each injured passenger and the ticket record sheet confirming the ticket’s validity for the given route;
• the accident report prepared by the traffic police;
• a certificate issued by authorized organizations confirming the degree of bodily injury or death;
• documents confirming expenses for treatment, purchase of necessary medications, prosthetics, and patient care resulting from the insured event.
