1. GENERAL TERMS
This website is owned by Moldasig Insurance Company S.A. By placing an order in the online store, the Buyer accepts the Terms and Conditions of sale of goods/products and/or provision of services, based on the legislation of the Republic of Moldova (hereinafter referred to as the "Terms"), presented below.
Using the website implies acceptance of the Terms proposed by Moldasig S.A., in accordance with Law No. 284/2004 on Electronic Commerce. The relationships between the client and the seller are regulated by Law No. 105/2003 on Consumer Protection, Law No. 92/2022 on Insurance or Reinsurance Activity, Law No. 106/2022 on Mandatory Civil Liability Insurance for Damage Caused by Vehicles, Insurance Conditions, and other regulatory acts adopted in accordance with this legislation. Moldasig S.A. reserves the right to update or modify these Terms at any time without prior notice. Continued use of the website after changes are made implies acceptance of these Terms.
2. PERSONAL DATA PROTECTION
By using the website www.moldasig.md, you agree to the collection and processing of personal data necessary for processing/confirming/executing requests related to the purchase of insurance services.
Personal data is processed only for legitimate purposes, such as providing the requested services, promotions, including Google Analytics, cookies, and notifications/newsletters.
The website www.moldasig.md uses cookies, and acceptance of these terms and continued browsing and/or placing an order means tacit consent for the use of cookies.
All information containing personal data is stored and used only for the period necessary to achieve the purposes for which it was collected, and in accordance with the provisions of Law No. 133/2011 on the Protection of Personal Data.
We use security measures to prevent unauthorized access, maintain data accuracy, and ensure proper use of information on the website. Data transmission over the internet or through wireless networks cannot be fully protected. Therefore, as with other companies, we cannot guarantee the security of information provided by the Buyer, and they do so at their own risk.
In the case of the incapacity or limited capacity of the personal data subject, consent for processing personal data is provided in writing by their legal representative. The signing of the insurance contract can only be done with the legal representative.
By providing personal data, the applicant agrees to its processing for obtaining offers, contracts, and insurance policies, as well as other information or documents. If the applicant does not wish to provide their personal data via electronic communication channels, the conclusion of a specific insurance contract will not be possible.
Moldasig S.A. collects the applicant's IP address. This information is not used for identifying individuals.
3. INSURANCE SERVICE REQUESTS AND PAYMENT METHODS
Insurance services are just a few steps away:
- The applicant fills in the offer form according to the selected type of insurance;
- The applicant expresses agreement with the terms and conditions contained in this document;
- The applicant expresses consent for processing their personal data;
- The applicant enters/provides personal data and information, checking if they are correct at the time of entering/providing the data;
- The applicant must ensure that the data entered is correct, with the possibility of modifying them if discrepancies are noticed, remaining responsible for the accuracy of the data entered if the insurance premium is paid online. The amount of the insurance premium will depend on the correctness of the data entered by the applicant and the exchange rate (for insurance services, whose premium is calculated in foreign currency);
- The online calculator will display data about the amount of the insurance premium and other information (depending on the case). The applicant must familiarize themselves with the insurance terms specific to the selected insurance type.
- If the applicant accepts the offer from Moldasig S.A. to contract the service, they should create an account on the website www.moldasig.md, log into an existing account on the said website, or use their personal Facebook or Google account for this purpose;
- The applicant must select the insurance period, make the necessary clarifications according to the selected type of insurance, conditions, and requirements established for the payment method, and complete the process of contracting insurance services;
- The applicant has the option to pay the insurance premium directly to the insurance company's account in full or in installments, depending on the type of insurance product requested and the contractual provisions. The proof of payment of the insurance premium will be the document issued by the insurer, such as a cash receipt, payment order, or electronic receipt;
- Online payment is made with maximum security using a payment card, which allows online transactions. After payment is made, you will receive payment confirmation at your email address;
- The payment processor uses a secure system based on the latest version of the 3D-Secure security standard, which means a new global approach to purchase authentication in secure online transactions. This security measure involves redirecting the user to a secure page when making the payment, where the cardholder's authentication is done by assigning a one-time code for each online transaction;
- Payment processing is accepted through acquiring bank centers from the Republic of Moldova using debit/credit cards from Visa International Limited, MasterCard Inc. Thus, the applicant/payer agrees that the debit/credit card details provided must be correct and accurate, and they will not use a debit/credit card that is not legally owned by them or whose use is not authorized by the legal cardholder.
- The applicant/payer agrees and undertakes to provide correct and valid details about their debit/credit card. The applicant/payer guarantees, agrees, and confirms when initiating an online payment and providing card details. The following data will be requested for payment: Card number (16 digits); Expiration date (month and year); CVC or CVV code (3 digits); Name and surname on the payment card; These details are transmitted with all necessary security measures. Information is transmitted in encrypted form and stored only on a specialized payment system server.
- The payment method by bank card involves redirection via secure channels to the BC Moldova Agroindbank S.A. portal and does not store sensitive data (such as card data or cardholder details). The insurance premium is paid in MDL, and if the card's currency differs, the conversion rate of the issuing bank will be applied. The insurer does not collect any other payments than the insurance premium; fees and/or other payments may be withheld according to the payment system of the bank or Visa International Limited, MasterCard Inc. If erroneous data is entered for the insurance contract or premium, the transaction will not be processed, and funds will not be deducted.
- Refunds are made only to the payment card used for the purchase.
- The electronic insurance contract is considered concluded when the insurance premium or the first installment is received in the insurance company's account or upon confirmation of the payment.
- The insurance policy and contract will be available for download in the "Personal Account" section under "Insurance Policies" or can be physically picked up from the insurance company's office.
- The "Green Card" insurance certificate is a special document, and currently, it is issued exclusively in paper format, available to be physically picked up from the insurance company's office.
- The validity of the RCA or Green Card insurance policy can be verified on the official website of the National Bank of Moldova - https://rca.bnm.md/.
4. INSURANCE CONTRACTS, CANCELLATION/RESOLUTION PROCEDURE
In accordance with Law No. 92 of 07.04.2022 on insurance and reinsurance activity, the Civil Code of RM, Law No. 284 of 22.07.2004 on information society services, the contract concluded through remote electronic means is identical to the traditional contracts and has the same legal force between the parties. The insurance contract may be modified or resolved based on a written request submitted to the insurance company's office by the interested party, and only in accordance with the current legislation, the contract, or the insurance conditions.
Cancellation of the contract may only be done within 24 hours before the start of the insurance period specified in the contract. The refund of the insurance premium in case of cancellation of the contract will be made within 10 business days or 14 calendar days. Otherwise, resolution may only take place at the central office of the insurance company and only under the conditions provided by the current legislation.
The legal basis of the online-issued insurance policy (through remote electronic means) is identical to traditional insurance, in accordance with the current legislation of the Republic of Moldova regarding the insurance system (Law No. 92 of 07-04-2022 on insurance or reinsurance activity), the Civil Code, and the general and specific conditions of insurance corresponding to the selected type of insurance. Also, the online mode of this service is regulated by Law No. 284 of 22.07.2004 on e-commerce. According to legal force, the electronic contract is equivalent to the written contract signed by the parties and stamped.
Resolution may occur at the request of the insurer or contract holder/insured only if the opposing party does not fulfill its obligations under the contract or violates the law.
In the case of resolution due to loss of interest, the insurer/insured must pay only that part of the premium that corresponds to the duration of the risk, and the insurer has the right to retain a management fee for concluding the insurance contract. The insurer is entitled only to the premium corresponding to the insurance period that actually elapsed before the resolution date, except in cases where an insured event occurred during the insurance period. In such circumstances, the insurer retains the entire amount of the insurance premium.
The parties may request the resolution of the insurance contract in other cases expressly provided by law or in accordance with the insurance conditions or the contract.
Any complaint may be officially recorded by sending an electronic message or submitted physically to the company's office. The information published on this page may be changed in whole or in part without prior notice to users.
5. PRIVACY POLICY
In accordance with the provisions of Law No. 133/2011 on the protection of personal data, the service provider processes personal data. Personal data is processed in good faith and in accordance with legal provisions. Personal data processing is done using mixed means (automatic and manual), in compliance with legal requirements and in conditions that ensure the security, confidentiality, and respect for the rights of the data subjects.
The provider collects and processes only the personal data provided by consumers when placing an order: first name, last name, phone number, address, mailing address.
Personal data is used exclusively for managing the website, granting access to special information, delivering orders, or contacting the consumer to fulfill the delivery. By this notice, users and consumers are informed that their personal data will be processed and used. The service provider processes the personal data of users and consumers provided while browsing, using, and registering on the website wwww.moldasig.md.
Any information provided by users and consumers of the website wwww.moldasig.md will be considered and will represent express consent for the use of personal data by the Provider.
